Welcome to Seekers & Keepers. These Terms of Service set out the agreement between you and Seekers & Keepers (referred to as we, us or our) governing your access to and use of our premium companionship and lifestyle platform. By creating an account, browsing our directories or otherwise using the platform, you confirm that you have read, understood and agreed to be bound by these terms. 1. About these terms
These terms work alongside our Privacy Policy, Community Guidelines and any additional conditions we publish for specific features. Where a conflict arises, the feature-specific conditions will apply to that feature only. We may update these terms from time to time; when we do, we will revise the effective date shown above and, where changes are material, we will endeavour to notify you in advance.
2. Eligibility & account registration
Seekers & Keepers is an adults-only platform intended for a mature Australian audience. To register and maintain an account, you must satisfy each of the following requirements:
- You are at least eighteen (18) years of age, or the age of majority in your state or territory, whichever is greater.
- You have the legal capacity to enter into a binding agreement and are not barred from doing so under any applicable law.
- The information you provide during registration is accurate, current and complete, and you will keep it up to date.
- You will maintain the confidentiality of your login credentials and accept responsibility for all activity that occurs under your account.
3. Nature of our service
We provide an online venue that allows members to create profiles, discover one another and arrange lawful social companionship. We are a technology and hosting provider only. We do not employ, represent or act as an agent for any member, and we are not a party to any arrangement, meeting or transaction made between members. Any agreement you reach with another member is strictly between the two of you.
Your Rights & Responsibilities
4. Acceptable use
We ask every member to treat the community with courtesy, discretion and respect. You agree to use the platform lawfully and in good faith, and you must not engage in conduct that harms other members, ourselves or third parties.
What you may do
- Create and manage a profile that honestly represents you and your interests.
- Communicate respectfully with other members through the tools we provide.
- Arrange lawful, consensual social meetings on terms you and another member freely agree.
- Report any content or behaviour that appears to breach these terms or our guidelines.
What you must not do
- Impersonate another person, misstate your age or provide misleading profile details.
- Publish content that is unlawful, defamatory, harassing, explicit beyond our stated standards, or that infringes the rights of others.
- Solicit or facilitate any activity that is illegal in your state or territory.
- Collect, scrape or misuse other members' personal information, or use the platform to send unsolicited commercial messages.
- Attempt to interfere with, disrupt or gain unauthorised access to our systems or another member's account.
5. Your content
You retain ownership of the photographs, descriptions and other material you upload. By posting content, you grant us a non-exclusive, royalty-free licence to host, display and distribute that content solely for the purpose of operating and promoting the platform. You are responsible for ensuring you hold all necessary rights to the content you share and that it complies with our standards.
6. Safety & discretion
Your wellbeing matters to us. We encourage you to exercise sensible caution, protect your personal details until you feel comfortable, and meet new acquaintances in a manner that feels safe to you. While we offer verification tools and moderation, we cannot guarantee the identity, conduct or intentions of any member.
Payments, Liability & Termination
7. Memberships & payments
Certain features are available through paid memberships or one-off purchases. Where you choose a paid plan, the following conditions apply:
- Fees, billing cycles and inclusions are described at the point of purchase and are payable in Australian dollars unless stated otherwise.
- Subscriptions renew automatically at the end of each billing period until you cancel, which you may do at any time through your account settings.
- Except where required by the Australian Consumer Law, fees already paid are generally non-refundable for partial periods.
We may change our pricing from time to time, and any change will take effect from your next billing cycle after we have given you reasonable notice.
8. Limitation of liability
To the fullest extent permitted by law, we provide the platform on an as is and as available basis. We do not warrant that the service will be uninterrupted, error-free or entirely secure. Nothing in these terms excludes any rights or guarantees you have under the Australian Consumer Law that cannot lawfully be excluded. Subject to those rights, we are not liable for indirect or consequential loss arising from your use of the platform or from any interaction between members.
9. Suspension & termination
You may close your account at any time. We may suspend or terminate your access where we reasonably believe you have breached these terms, where required by law, or to protect the safety of the community. We will act proportionately and, where practicable, give you notice and an opportunity to respond.
10. Governing law & contact
These terms are governed by the laws of Australia, and you submit to the non-exclusive jurisdiction of its courts.
